Terms and Conditions (T&C) for the internet portal "esperst"

Scope of Application
The following T&C govern the use of the internet portal “esperts” and the booking of appointments for accompanying services at official appointments with authorities, banks, utility companies, and similar institutions. By using the website and booking a service, the user declares their agreement with these T&C.

Service Description
“esperts” enables the user to book an employee through the website in the desired city at a specific time who speaks the user’s language and accompanies and supports them during official appointments. The prices for the respective services are displayed on the website and include the applicable value-added tax (IVA). The booking is done directly through the website without registration, but personal data of the booker is required for processing the order. As part of the order, the data is stored and passed on to the respective employee. In some cases, the data may also be shared with authorities for whom an appointment is organized by “esperts”. Prices and Payment Terms
For booking an appointment, “esperts” reserves the right to charge either the full price or a deposit. No further payments are required if the full payment is made on-site during the appointment. In the case of a deposit, the remaining amount is to be paid directly to the employee before the appointment, who will issue a receipt. The same procedure applies if no payment is made during the booking. In the event of a cancellation by “esperts” for reasons attributable to us, the full amount will be refunded. If the user fails to attend an appointment without sufficient excuse or justification, the deposit as well as the remaining amount become due. If an appointment with an authority is unsuccessful due to the user’s negligence or missing documents, no refund will be provided.

Choice of Law and Jurisdiction
Spanish law applies to all legal relationships between “esperts” and the user. The place of performance and exclusive place of jurisdiction is the registered office of “esperts”.

Severability Clause
Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, a legally permissible regulation shall apply that comes closest to the economic purpose of the invalid provision.

Amendment of the T&C
“esperts” reserves the right to change or update these T&C at any time. The amended T&C will be published on the website and come into effect at the time of publication.
